These Terms and Conditions govern your access to and use of this website, including the purchase of books, book sets, educational materials and other products offered through it. 

By visiting the website, creating an account, placing an order or using any part of the website, you agree to be bound by these Terms and Conditions, our Privacy Policy, Shipping Policy, Cancellation and Return Policy, and any other policy displayed on the website. 

Please read these Terms and Conditions carefully before placing an order.

1. Definitions

For the purpose of these Terms and Conditions: 

“Kenbee”, “Company”, “we”, “us” or “our” means Kenbee Edutech Private Limited. 

“Website” means shop.kenbeeschoolbooks.com and the webpages, features and services available through it. 

“Customer”, “you” or “your” means any person, parent, guardian, school, institution or organisation accessing the website or purchasing a product. 

“Product” means any book, book set, workbook, educational material, activity material or other item listed for sale on the website. 

“Order” means a request submitted by a customer to purchase one or more products from the website.

2. Eligibility to Use the Website

You must be at least 18 years old and legally competent to enter into a binding contract to place an order. 

Products intended for children must be ordered by a parent, guardian, school representative or another legally competent adult. 

By placing an order, you confirm that the information submitted by you is accurate and that you are authorised to use the selected payment method.

3. Customer Accounts

You may be permitted to purchase products as a guest or by creating an account. 

You are responsible for: 

  1. Providing accurate and complete information. 
  2. Keeping your login credentials confidential. 
  3. Restricting unauthorised access to your account. 
  4. Informing us promptly if you suspect unauthorised use of your account. 

You will be responsible for activities carried out through your account unless the activity occurred because of a security failure directly attributable to us.

4. Product Information

We make reasonable efforts to ensure that product titles, descriptions, class levels, subjects, book parts, cover images, prices and other information displayed on the website are accurate. 

However: 

  1. Product colours may appear slightly different depending on the customer’s screen, device and display settings. 
  2. Minor differences may occur between website images and the final printed product because of printing, binding or production variations. 
  3. Packaging may be changed without affecting the educational content or usability of the product. 
  4. The suitability of a book for a particular student may depend on the student’s age, learning level, school curriculum and teacher recommendations.
     

Any material difference affecting the nature, quantity or usability of a product will be communicated or corrected wherever reasonably possible. 

5. Books Sold as Sets

Certain Kenbee books may be divided into multiple parts and offered together as a complete book set. 

Where a product is described as a set, bundle, complete set or set of books, the product includes only the books or components specifically listed on the relevant product page. 

Individual books forming part of a set may not be available for separate purchase unless the website expressly provides an option for individual sale. 

Any discount offered for purchasing a complete set will apply only to the qualifying set and in accordance with the offer displayed at checkout.

6. Prices, Taxes and Charges

All prices are displayed in Indian Rupees unless otherwise stated. 

The product page or checkout page will display, as applicable: 

  1. The selling price. 
  2. Applicable taxes. 
  3. Shipping or delivery charges. 
  4. Discounts or promotional reductions. 
  5. The final amount payable.
     

The total price payable will be shown before the customer confirms the order. 

Prices may change without prior notice. However, a price change will not normally affect an order that has already been accepted and paid for, except where the displayed price resulted from an obvious technical or typographical error.

7. Placing an Order

The display of a product on the website is an invitation to place an order and does not by itself constitute acceptance of the order. 

An order is considered submitted when you complete the checkout process and receive an order acknowledgement. 

An order is considered accepted when: 

  1. Payment is successfully received or authorised, where advance payment is required; and 
  2. We confirm acceptance or begin processing or dispatching the order. 

An automated order acknowledgement does not guarantee that the product is available or that the order has been accepted.

8. Right to Reject or Cancel an Order

We may reject or cancel an order before dispatch for reasons including: 

  1. The product is unavailable or out of stock. 
  2. Incorrect pricing or product information was displayed because of a technical error. 
  3. Payment was unsuccessful, reversed or flagged for review. 
  4. The delivery address is incomplete, incorrect or outside the serviceable area. 
  5. The order appears fraudulent, suspicious or unauthorised. 
  6. The quantity ordered exceeds applicable purchase limits. 
  7. A force majeure event prevents fulfilment. 
  8. The order violates these Terms and Conditions or applicable law. 


Where we cancel a prepaid order, the amount received for the cancelled product will be refunded through the original payment method or another mutually agreed method.

9. Payment

Available payment methods will be displayed during checkout and may include online payment, UPI, cards, net banking, wallets, cash on delivery or any other method made available by us. 

Payment services may be provided by independent payment gateways, banks or financial service providers. Their separate terms, security procedures and processing timelines may apply. 

We do not normally store complete card, banking or UPI credentials on our website. 

You agree to provide valid payment information and authorise the applicable payment provider to process the payment. 

A payment being deducted from your account does not by itself confirm acceptance of an order. In case of an unsuccessful transaction where money has been deducted, the reversal timeline may depend on the bank or payment service provider.

10. Cash on Delivery

Cash on delivery may be available only for selected products, order values and delivery locations. 

We may verify cash-on-delivery orders by telephone, SMS, WhatsApp or email before dispatch. 

We reserve the right to disable cash on delivery for: 

  1. Certain pincodes or locations. 
  2. High-value or bulk orders. 
  3. Customers with repeated refusal or non-acceptance of deliveries. 
  4. Products made or packed specifically for an order. 
  5. Orders requiring advance payment. 

11. Shipping and Delivery

Orders will be shipped according to the Shipping Policy displayed on the website. 

Estimated delivery dates are provided in good faith and are not guaranteed unless expressly stated. 

Delivery may be delayed because of circumstances including: 

  1. Courier or logistics delays. 
  2. Incorrect or incomplete addresses. 
  3. Customer unavailability. 
  4. Weather conditions or natural disasters. 
  5. Government restrictions. 
  6. Transport disruptions. 
  7. Public holidays.

Customers must provide a complete delivery address, correct postal code and reachable telephone number. 

An order may be treated as delivered when the courier records delivery to the address, recipient, authorised representative, security desk, reception desk or other person available to receive it at the supplied delivery address. 

12. Inspection at Delivery

You should inspect the external condition of the package at the time of delivery. 

Where the package is visibly damaged, opened, tampered with or incomplete, you should: 

  1. Record photographs or a short video before opening the package. 
  2. Inform the delivery representative, wherever possible. 
  3. Contact Kenbee within the period specified in the Return and Refund Policy. 
  4. Retain the packaging, invoice and shipping label until the complaint is resolved. 

Evidence may be requested to verify claims relating to damaged, missing, incorrect or incomplete products. 

13. Order Cancellation by the Customer

You may request cancellation before the order is dispatched by using the available cancellation facility or contacting customer support. 

Cancellation cannot be guaranteed after processing, packing or dispatch has begun. 

Where an order has already been dispatched, it may be handled under the applicable return or delivery-refusal provisions. 

No cancellation charge will be imposed unless it is clearly disclosed before purchase and is permitted under applicable law.

14. Returns, Replacements and Refunds

Returns, replacements and refunds will be governed by the Return and Refund Policy displayed on the website. 

Subject to verification and applicable law, a replacement or refund may be considered where: 

  1. The product received is damaged. 
  2. A printing or binding defect materially affects the product’s use. 
  3. The product is different from the product ordered. 
  4. One or more items are missing from a book set. 
  5. The product does not materially match its advertised description. 
  6. The order is delivered later than the stated delivery schedule, except where the delay results from force majeure or circumstances permitted under applicable law. 

A return may be refused where: 

  1. The wrong class, level, subject or book was ordered by the customer. 
  2. The product has been used, written upon, marked, torn or damaged after delivery. 
  3. Pages, components, accessories or packaging are missing. 
  4. The request is made after the return-request period. 
  5. The product was purchased under a clearly disclosed non-returnable category, subject to applicable law. 
  6. The customer cannot provide reasonable evidence of purchase. 
  7. The product was purchased from an unauthorised third-party seller.
     

Nothing in these Terms and Conditions limits any statutory right available to a consumer under applicable law.

15. Refund Processing

Approved refunds will generally be processed through the original payment method. 

The time taken for a refund to appear in the customer’s account may depend on the bank, card network, payment gateway or financial service provider. 

Shipping charges may be refunded where the return results from an incorrect, damaged, defective, incomplete or materially misrepresented product supplied by us. 

For discretionary returns not caused by our error, return-shipping or original-shipping charges may be deducted where clearly stated in the Return and Refund Policy and permitted by law. 

16. School, Institutional and Bulk Orders

Schools, distributors, booksellers and institutions may request quotations or place bulk orders. 

Bulk orders may be subject to separate commercial terms relating to: 

  1. Minimum quantities. 
  2. Institutional pricing. 
  3. Advance payment. 
  4. Credit approval. 
  5. Delivery schedule. 
  6. Transport charges. 
  7. Custom packing. 
  8. Returns. 
  9. Replacement of damaged stock.

Where separate written terms, quotations, invoices, purchase orders or agreements apply, those terms will prevail over these general Terms and Conditions to the extent of any inconsistency. 

Products purchased for resale, distribution or commercial purposes may not qualify as consumer purchases under all provisions of consumer law. 

17. Promotions, Coupons and Discounts

Promotional codes, discounts and special offers:

  3. May have minimum-purchase requirements. 
  4. Cannot normally be exchanged for cash. 
  5. Cannot be combined unless expressly permitted.

Individual learning outcomes may vary depending on factors including: 

  1. The learner’s age and existing ability. 
  2. Regularity of study. 
  3. Teacher guidance. 
  4. Parent involvement. 
  5. Classroom practices. 
  6. The school’s curriculum and assessment methods. 

No statement on the website should be interpreted as a guarantee of admission, academic rank, examination result, school performance or any particular educational outcome. 

19. Intellectual Property Rights

All rights in the website and Kenbee products, including copyrights, trademarks, trade names, logos, book covers, illustrations, page designs, worksheets, lesson plans, text, graphics, photographs, videos, downloadable materials and software, belong to Kenbee or its authorised licensors. 

Purchasing a book gives the customer ownership of the physical copy purchased. It does not transfer copyright or intellectual property rights in the book. 

Except where expressly permitted in writing or allowed by law, you must not: 

  1. Copy, scan, photocopy or reproduce substantial portions of a Kenbee book. 
  2. Upload book pages or digital files to websites, apps, drives or social media. 
  3. Sell or distribute unauthorised digital copies. 
  4. Remove copyright, trademark or ownership notices. 
  5. Modify, translate, adapt or create derivative commercial materials. 
  6. Use Kenbee content to manufacture competing products. 
  7. Use automated tools to extract or copy website or product content. 
  8. Misuse Kenbee’s name, logo or product images. 

Schools may use legitimately purchased books for normal classroom teaching, subject to copyright law and any licence specifically provided with the product.

20. Reviews, Feedback and User Content

You may be allowed to submit reviews, feedback, images, questions or other content. 

By submitting content, you confirm that: 

  1. It is based on a genuine experience. 
  2. It is accurate to the best of your knowledge. 
  3. You have the right to submit it. 
  4. It does not violate another person’s privacy or intellectual property rights. 
  5. It is not defamatory, abusive, discriminatory, unlawful, misleading or obscene.

Nothing in these Terms and Conditions excludes liability for fraud, wilful misconduct, defective products, unfair trade practices or any liability that cannot legally be excluded or restricted.

26. Indemnification

To the extent permitted by law, you agree to indemnify Kenbee against claims, losses or expenses resulting directly from:

  3. Your infringement of another person’s intellectual property or legal rights. 
  4. Fraudulent or unauthorised activity carried out through your account because of your deliberate act or negligence.
     

This clause does not apply to losses caused by Kenbee’s own breach, negligence or unlawful conduct. 

27. Force Majeure

Kenbee will not be responsible for a delay or failure caused by an event beyond its reasonable control, including natural disaster, flood, fire, epidemic, pandemic, war, civil disturbance, strike, government action, transport disruption, courier interruption, power failure, telecommunications failure, cyberattack or shortage of essential materials. 

We will make reasonable efforts to inform affected customers and fulfil, reschedule or refund orders as appropriate.

28. Changes to These Terms

We may revise these Terms and Conditions to reflect changes in our operations, website features, products, policies or applicable law. 

The revised version will be posted on the website with an updated effective date. 

Changes will apply prospectively and will not ordinarily alter the terms applicable to an order already accepted, unless required by law or agreed with the customer.

29. Governing Law and Jurisdiction

These Terms and Conditions will be governed by the laws of India.

Nothing in this clause prevents a consumer from approaching an appropriate Consumer Commission or another competent authority in accordance with applicable law.

The remaining provisions will continue to remain valid and enforceable.
